Wikie Art Ltd is engaged in the creation, sale, marketing, supply, exhibition, and distribution of artworks and creative products including but not limited to:

• Original Paintings
• Limited Edition Prints
• Canvas Reproductions
• Sculptures
• Decorative Art
• Framed Artwork
• Digital Art
• Portrait Commissions
• Corporate / Hospitality Installations
• Interior Art Solutions

We may also sell artworks sourced from authorized third-party artists or creative partners.

You may use our services only if:

• You are at least 18 years old; or
• You are supervised by a parent/legal guardian.

You confirm all information provided to us is accurate and complete.

These Terms apply across all channels.

We make reasonable efforts to accurately display artwork colors, sizes, finishes, framing, and textures.

However, due to lighting, photography, handcrafting, screen resolution, or production methods:

• Actual colors may vary slightly
• Texture may vary
• Dimensions may have minor tolerances
• Framing may differ slightly

Such minor differences shall not be treated as defects.

All prices are listed in Nigerian Naira (₦) unless stated otherwise.

We reserve the right to:

• Change prices without notice
• Correct pricing errors
• Apply temporary promotions
• Withdraw products from sale

If an obvious pricing mistake occurs after payment, we may cancel the order and refund payment.

We currently accept approved payment methods communicated at checkout or invoice stage.

Orders are confirmed only after cleared payment.

We reserve the right to reject suspicious, incomplete, fraudulent, or unauthorized transactions.

Bank charges, transfer fees, or payment gateway charges may apply depending on payment method.

For custom commissions:

• 70% non-refundable deposit is required before work begins.
• Remaining balance must be paid before delivery.
• Clients receive 2 revisions unless otherwise agreed.
• Additional revisions may attract extra fees.
• Production timelines are estimates only.

If a client delays approvals, responses, or required materials, delivery timelines may be extended.

Customers are responsible for shipping fees unless otherwise stated in writing.

Delivery timelines are estimates only and may be affected by:

• Traffic
• Logistics delays
• Weather
• Customs
• Public holidays
• Operational disruptions

We are not liable for courier delays beyond our direct control.

If an item arrives damaged, the issue shall be assessed case-by-case.

Customers must notify us within 48 hours of delivery and provide:

• Clear photos
• Packaging images
• Delivery details
• Description of damage

Depending on findings, we may offer:

• Replacement
• Repair
• Partial refund
• Full refund
• Courier claim assistance

Our decision shall be reasonable and based on available evidence.

Ownership of physical artwork transfers only after:

• Full payment is received; and
• Product has been delivered or collected.

Until then, title remains with Wikie Art Ltd.

All intellectual property rights in:

• Artwork images
• Designs
• Logos
• Website content
• Branding
• Product descriptions
• Social media content

remain the property of Wikie Art Ltd or relevant rights holders.

Purchase Does Not Transfer Copyright

Buying artwork grants ownership of the physical item only, unless expressly agreed in writing.

It does not automatically grant:

• Reproduction rights
• Commercial licensing rights
• NFT rights
• Merchandising rights
• Publishing rights

No copying or commercial use is permitted without written consent.

Where works are sold on behalf of artists or partners:

• We act as seller, representative, or authorized distributor.
• Rights may remain with the original creator.
• We rely on artist warranties regarding authenticity and ownership.

We reserve the right to remove disputed works.

Returns are not accepted for:

• Change of mind
• Buyer preference changes
• Minor color differences
• Custom commissioned work
• Damage caused after delivery

Claims must be made within 48 hours of delivery.

Refunds or replacements may be considered only where:

• Wrong item delivered
• Significant undisclosed defect
• Proven delivery damage
• Material mismatch from description

Approved refunds are processed within reasonable time.

We may cancel any order where:

• Payment fails
• Fraud is suspected
• Product becomes unavailable
• Pricing error occurred
• Customer breaches these Terms
• Delivery destination is impractical or unsafe

Refunds, where applicable, shall be made reasonably.

You agree not to:

• Defraud us
• Misrepresent identity
• Abuse staff
• Infringe copyrights
• Hack systems

• Use bots or scraping tools

We may restrict access without notice.

We do not guarantee uninterrupted operation of:

Temporary outages may occur.

Except where required by law, products and services are provided as available.

• Continuous stock
• Future artwork value increase
• Investment return
• Uninterrupted site access
• Exact screen color match

Art value is subjective and market-driven.

To the maximum extent permitted by law, Wikie Art Ltd shall not be liable for:

• Indirect losses
• Consequential damages
• Lost profits
• Emotional distress
• Delayed delivery losses
• Third-party courier failures
• Customs delays
• Missed opportunities

Where liability applies, total liability shall not exceed the amount paid for the affected order.

Nothing excludes rights that cannot legally be excluded under Nigerian law.

You agree to indemnify and hold harmless Wikie Art Ltd against claims, damages, losses, liabilities, and expenses arising from:

• Your breach of these Terms
• Fraudulent conduct
• Misuse of products
• Infringement of third-party rights

We may collect customer data including:

• Phone number
• Delivery address
• Payment records
• Communication history

Such data shall be used for order fulfillment, customer service, legal compliance, and promotions where lawful.

By engaging with us, you may receive promotional communications unless you opt out.

We are not liable for delay or failure caused by events beyond reasonable control, including:

• Pandemic
• Riot
• Government restrictions
• Power failure
• War
• Strikes

Parties shall first attempt amicable settlement.

If unresolved, disputes shall be submitted to a court of competent jurisdiction in Lagos State, Nigeria, unless otherwise required by law.

These Terms are governed by the laws of the Federal Republic of Nigeria, including:

• Federal Competition and Consumer Protection Act 2018
• Nigerian Copyright Act 2022
• Applicable contract and commercial laws
• Nigerian Data Protection laws

If any provision is found invalid, remaining provisions remain enforceable.

These Terms represent the full agreement between you and Wikie Art Ltd concerning purchases and use of services.

We may amend these Terms at any time by posting updates online.

Continued use after updates means acceptance.
